True pet lovers will tell you that having pets is no different than having children. They are members of our family, and vulnerable ones at that. They don't grow up, go to college, earn a living. Once we make the decision to get a pet, it's a lifetime commitment.

Family law lawyers are discovering that the issues related to pets are important to their clients. Resolving those issues may not be so simple as the family law statutes don't address pet custody issues. As a result, families have to fashion their own solutions. Sometimes this is only possible with the help of a skilled mediator - an impartial third party that can guide the couple through the decision making process.

Before you go to court, go to mediation It save time, money and emotional energy. For more information on pet custody mediation, you can reach out to me at 407-977-8080.

Mariah Carey and Nick Cannon have eight (8) dogs - they've split up their fortunes and determined visitation for their children but they can't agree on the dogs!

Relationship turmoil does have an effect on your pets - who they live with, how they are treated, their environment. Courts are not equipped to help couples work out decisions regarding their pets. Pet mediation and alternative dispute resolution is the best way to address the unique needs of your pets.

Getting a prenuptial agreement (a/k/a a prenup)? If you have pets considering adding provisions regarding your shared pets (a prepup)! As the incidence of disputes over shared custody of pets continues to rise, thinking about how the pets would be shared in the event of a split is a good decision.

Far too often, couples fail to address how the pets will be handled in the event of a breakup only to find out that their "ass-umption" about what would happen is wrong. Pets are not furniture, they are beloved members of our family and they deserve to be treated with the same consideration as our children.

Want more information about the current state of pet custody? Here's a case that demonstrates the courts are taking a harder look at this issue. Better to create your own solution than to leave something this important to the decision making power of the courts.

Most courts will not hear disputes related to the custody of pets - this is because pets still are viewed as property - not a living, breathing being whose needs and emotions also need to be taken into consideration.

Divorce is difficult enough. The pets suffer from the loss of daily contact with the people they love. They have not changed their loyalties just because one spouse has decided they can't/don't want to live with another. Our pets love us unconditionally - they don't want a divorce.

Protect your pets when your relationship sours - ask a pet mediator to help you resolve your dispute.

Pet custody can be a big issue in a divorce - especially true because most courts are equipped to handle pet custody issues in the same way they handle "time sharing" for the kids.

Pet custody disputes are best settled in mediation where the couple can craft their own solution and not end up with one imposed arbitrarily by the court. Don't let a non-family member decide the fate for your pets. Take pet custody issues into your own hands and get an experienced mediator, preferably a pet .lover who can help work through these sensitive issues.

Historically, pets have been treated as property. In this landmark case, the judge is actually going to investigate "the best interests" of the dog - a standard generally reserved for children. Times, they are a changing.
Pet Mediation is a growing trend and more pet lovers are opting to create personalized solutions rather than become a victim of the court system.
I'm getting a lot of interesting responses. Some think its great - especially family law attorneys who have had experience with couples who can't settle their marital disputes because of the pets. One friend told me they actually had to go to trial over custody of the dog - only the husband was ultimately too embarrassed to face the judge over the issue and settled the morning of trial.

I'm working on The Pet Lover's Guide to Mediation, a helpful booklet that will guide you through the mediation process and why it's better than leaving the decision to a judge. It should be available soon and you can look for it hear and on Amazon.com.
I see the need to help families with their pet related issues resolve them outside of the court system. These are issues that require creative, resourceful, solutions. It allows the parties to craft their own decisions and find the right solution. Don't leave the future of your pet up to a judge - use a mediator and decide for yourself. Courts can be unpredictable in the resolution of disputes related to pets. There isn't any statutory law and reported cases may also be limited.
Pet mediation would offer couples an alternative to resolving their pet related disputes without the interference and expense of a lengthy court proceeding.
